New Labour Laws In India 2022 – Indian labour law regulates the labour and employees in India. The law seeks to be a mediator between workers, trade unions, entities, and the government. The constitution provides the rights to protect labour and workers from unfair practices by business entities. The labour laws help in maintaining a fair relationship between employees and their companies.

The 29 Indian labour laws are divided into 4 labour codes

  • The Code on Wages, 2019
  • The Industrial Relations Code, 2020
  • The Occupational Safety, Health, and Working Conditions Code, 2020
  • The Code on Social Security, 2020

However, the Government of India is planning to implement new labour laws! The new laws will enable more investment and working opportunities in the country. The new labour laws are expected to be implemented from 1st July 2022.

Labour Law 2022 in India

The draft of new labour laws includes the following prospects:

  • Companies will have the right to increase the working hours from 8 hours to 12 hours.
  • However, companies increasing working hours will have to provide an additional leave in the week. The number of leaves in a week will increase from 2 to 3.
  • The basic salary should be 50% or more of total salary.
  • With increase in basic salary, PF and gratuity contribution will also increase, for both employees and companies.
  • The in-hand salary will decrease but post-retirement funds will increase. 
  • The salary structure and financial statements will be impacted with increase in basic salary of employees.

  • Companies will have the right to increase the working hours from 8 hours to 12 hours.

It is expected that it will take around three months for these new labour laws to come into existence. As of now, 23 states have made labour rules under the labour code. However, with new implementations, all states will have to follow the labour code.
