What is Triple Talaq
Triple Talaq, also known as talaq-e-biddat refers to the instant divorce that allows any Muslim man to legally divorce his wife by saying the word talaq (divorce) three times orally or in writing.
The topic of triple talaq in India has been a subject of controversy. It has raised issues of justice, gender equality, human rights, and secularism.
What is triple talaq bill?
Formally called the Muslim Women (Protection of Rights on Marriage) Act, 2019, the triple talaq bill is formed to protect the rights of married Muslim women, to prohibit divorce just by pronouncing the word talaq by their husbands and matters connected to it.
The bill is deemed to have come into force on 19th September 2018 and is applicable to the whole of India except the State of Jammu and Kashmir.
Triple talaq bill makes it illegal for a Muslim man to divorce his wife just by uttering the word “talaq” three times, also called talaq-e-biddat. The bill says that “Any pronouncement of talaq by a Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal.”
The bill also makes giving talaq-e-biddat a cognizable offence thereby giving power to the police officer to arrest the offender without a warrant.
The bill also offers scope for reconciliation without going through the process of nikah halala provided both the sides agree to settle the dispute and stop legal proceedings.
triple talaq bill allows a Muslim woman divorced through the triple talaq to demand maintenance for herself and her dependent children. The amount of allowance shall be decided by the Magistrate.
Bill also allows a married Muslim woman to the custody of her minor children in a manner as decided by the Magistrate.
What is triple talaq bill
The Muslim man pronouncing instant triple talaq may attract a jail term of up to three years though he is entitled to bail. He shall also be liable to pay a fine.
To keep a check on the misuse of the triple talaq bill, this is applicable only if a complaint is filed by the aggrieved woman or any of her relative by blood or marriage.
Countries where triple talaq is banned?
Countries like Saudi Arabia, United Arab Emirates, Pakistan, Jordan, Malaysia, Algeria, Iraq, Brunei, Egypt, Indonesia, Kuwait, and Morocco have already banned the instant Triple Talaq. In Afghanistan, triple talaq is invalid if it is given in only one sitting. And from now on, India has also been included in this list.
